Indexation
Having been involved at the heart of the 'indexation of periodical payments' cases, we feel that we have an ongoing duty to Claimants and Solicitors alike to make the application of ASHE 6115 as simple and understandable as possible.
Therefore, we have provided this dedicated page to the issue. We intend to provide ongoing practical advice and assistance to those who need to know what they should be receiving under such a periodical payments Order.
His Honourable Mr Justice Mackay was kind enough to say the following in the original Model Schedule Judgment [2008] EWHC 2424 (QB):
"It is, as I say, the result of very considerable negotiations between counsel, both of whom have acquired, I would suggest, unparalleled experience and skill in this field. It is also based on advice given to the claimant from an equally experienced independent financial adviser, Mr Cropper, from Dr Victoria Wass, a labour economist who gave evidence for the claimants in all three cases, and Professor G.H. Makepeace, a statistician."
Sir Christopher Holland, in approving the revised model Schedule [2008] EWHC 2948 (QB), said the following:
"My concern has been to ensure that often quite sophisticated concepts are expressed with a clarity that can command uniform compliance as guided by those advisers that come belatedly and afresh to this area of law and practice."
We hope that the documents included on this page are of assistance in this regard.
